Manama : The Chief of the Enforcement of Criminal Judgments Prosecution said the Public Prosecution’s role extends beyond the issuance of judgments in criminal cases to ensuring the enforcement of final judgments, including custodial sentences, fines, restitution and confiscation of funds, in accordance with the law.
He said the Public Prosecution also takes available legal measures to assist victims in recovering their financial rights, stressing that protecting victims’ rights and interests forms an important part of its work alongside enforcing judgments and administering justice.
Citing the case known as “Safqat” (Deals), he said the Public Prosecution investigated the case, questioned the defendants, heard witnesses and victims, traced and secured funds and related transactions, and appointed an asset manager pending a ruling before referring the defendants to trial.
The Public Prosecution continued to follow the case through the various levels of litigation and exercised its right to appeal until the judgments became final and enforceable.
The Execution Prosecution subsequently enforced the custodial sentence and took the necessary measures to execute the fine, confiscation and restitution orders, including opening a civil enforcement file before the Civil Execution Court.
He explained that victims who obtained compensation judgments or orders requiring the defendants to return their funds may, directly or through their lawyers, apply to the Civil Execution Court to enforce those judgments and recover their financial rights in accordance with the law.
The Public Prosecution is also prepared to cooperate with lawyers representing those affected by providing copies of the criminal judgments, subject to the applicable legal requirements.
